Intellectual property

Protecting your intangible assets, organising their use and taking action against infringement.

Our approach

Trademarks, know-how, software, creative works: intangible assets often make up a decisive share of a company's value, without always being formally protected. A missing registration or written assignment usually comes to light at the worst moment, during a sale or a dispute.

We secure ownership of your rights, organise their protection with OMPIC and internationally, govern their use by contract and act both in defence and on the offensive against infringements.

What we do

  • Prior-art searches and trademark filing strategy
  • Filings and portfolio management with OMPIC
  • Patents, designs and international protection
  • Copyright, software and assignment of rights
  • Licensing, assignment and co-development agreements
  • Infringement actions, infringement seizures and unfair competition

Frequently asked questions

Should you register your trademark before using it?
It is strongly advisable. A prior-art search followed by a filing avoids building a reputation on an unavailable sign, a situation that always costs more to fix than the original filing.
A contractor developed our software: do we own it?
Not automatically. Without an express and sufficiently precise assignment clause, the rights may stay with the developer. We audit your contracts and put things right where necessary.
What should you do about counterfeiting?
Gather the evidence first, before making any contact. We arrange official findings and, depending on what is at stake, send a formal notice, carry out an infringement seizure or bring court action.
